CONCORD, New Hampshire — A political consultant is facing a hefty fine of $6 million and more than two dozen criminal charges for sending out artificial intelligence-generated robocalls that mimicked the voice of President Joe Biden to voters ahead of New Hampshire’s presidential primary.
The Federal Communications Commission (FCC) announced on Thursday that Steven Kramer, the consultant behind the robocalls, is the first person to be fined for using generative AI technology. Additionally, the company responsible for transmitting the calls, Lingo Telecom, is facing a $2 million fine. However, both parties have the option to settle or further negotiate with the FCC.
Kramer has confessed to orchestrating a message that was sent to thousands of voters just two days before the state’s primary on January 23. The message featured an AI-generated voice similar to President Biden’s, using his trademark phrase “What a bunch of malarkey” and falsely claiming that voting in the primary would prevent voters from casting their ballots in November.
As a result of his actions, Kramer is now facing a total of 13 felony charges for violating a New Hampshire law that prohibits individuals from attempting to deter someone from voting using misleading information. In addition, he is also facing 13 misdemeanor charges for falsely representing himself as a candidate or through the actions of another person. These charges have been filed in four different counties and will be prosecuted by the state attorney general’s office.
Commitment to Free and Fair Elections
New Hampshire’s Attorney General, John Formella, has expressed his commitment to ensuring that the state’s elections remain free from unlawful interference. He commended the swift action taken by both the New Hampshire Department of Justice and the FCC in addressing the issue of harmful robocalls and voter suppression.
One of the robocalls falsely displayed the personal cellphone number of Kathy Sullivan, a former chair of the state Democratic Party who assisted in running Biden’s write-in campaign. Sullivan stated in an email that she hopes Kramer learns that there are consequences for attempting to manipulate an election.
Kramer, who specializes in get-out-the-vote projects, did not respond to requests for comment. In a previous statement to the Associated Press, he claimed that his intention was not to influence the election outcome but rather to raise awareness about the potential dangers of artificial intelligence. He had paid a magician in New Orleans $150 to create the recording used in the robocall.
Legal Ramifications
Voter suppression carries a sentence of 3½ to 7 years in prison, while impersonating a candidate is punishable by up to a year in jail. Kramer is scheduled to appear in court on June 5 and has stated that he is prepared to defend himself against the charges.
Despite facing legal consequences, Kramer maintains that his robocall did not suppress voter turnout, pointing to Biden’s victory in the Democratic primary as evidence. He also clarified that he acted alone, despite having done ballot access work for another former Democratic presidential candidate, Rep. Dean Phillips of Minnesota.
As the case progresses, Kramer remains defiant, stating, “I wrestled in college. I’m ready for the fight. If they want to throw me in jail, good luck.”
