Man Charged Under National Security Act 2023
A 64-year-old man, identified as Howard Michael Phillips, found himself in hot water when he was charged by the Metropolitan Police under the National Security Act 2023. The incident took place in London, where Phillips was taken into custody without a warrant on May 16. This new, controversial power given under Section 27 of the National Security Act 2023 allowed the police to detain him on suspicion of being involved in foreign power threat activity.
Court Appearance and Denial of Bail
Phillips appeared at Westminister Magistrates’ Court on Thursday to confirm his address and date of birth. However, Judge Daniel Sternberg denied him bail and ordered him to appear at the Old Bailey, the UK’s Central Criminal Court, on June 14. A warrant of further detention was granted at the Magistrates’ Court, allowing the police to keep him in custody until Thursday, May 23.
Charges and Involvement with Russia
Following consultation with the Crown Prosecution Service (CPS), Phillips was officially charged under Section 3 of the National Security Act 2023. This section deals with “materially assisting a foreign service”, with the police press report indicating that the charges are related to cooperation with Russia. The police have clarified that this arrest is not connected to any other recent charges or investigations and there is no believed threat to the wider public.

In an unrelated case in April, two British men were charged with aiding Russian intelligence services after a suspected arson attack on a Ukraine-linked business in London.
