However, defense attorney Michael Tomko argued that the witness in question had a history of drug use and regularly traveled to Baltimore to indulge in marijuana and crack cocaine. Tomko asserted that the witness was not present at the scene of the crime but was instead getting high on drugs that day.

Tomko highlighted the witness’s reputation for exchanging the use of his vehicle for drugs and claimed that the witness had cleaned the Mercedes in a vacant lot in Southwest Baltimore following the shooting.
