Man Charged in Fairmount Park Cold Case Now Facing Additional Sexual Assault Charges

PHILADELPHIA (WPVI) — The suspect arrested last week in connection with a 20-year-old cold case involving rape and murder in Fairmount Park is now facing charges in three other sexual assault cases.

Elias Diaz, a 46-year-old man, was apprehended on December 17 following two slashing incidents on the Pennypack Park trail in Northeast Philadelphia.

According to the police, DNA evidence collected from Diaz last week has linked him to the notorious Fairmount Park rape cases, including the murder of Rebecca Park. Rebecca was tragically attacked and killed while jogging alone in the park on July 13, 2003.

On December 20, the district attorney’s office officially charged Diaz with rape, murder, aggravated indecent assault, abuse of a corpse, and other crimes related to Rebecca Park’s killing.

Exactly one week later, Diaz has now been formally charged with three additional sexual assaults, two of which occurred in Fairmount Park in 2003, and one in Pennypack Park in 2007.

The district attorney’s office has upgraded Diaz’s charges to include rape, attempted rape, kidnapping, attempted kidnapping, aggravated assault, and related offenses.

Series of Slashings in Pennypack Park

The first slashing attack occurred on November 22, 2023, around 8:15 a.m. in the vicinity of 2800 Holme Avenue.

According to the victim, who was running on the trail, he noticed a bicyclist ahead and announced his approach. However, the bicyclist, later identified as Elias Diaz, became enraged.

Allegedly, Diaz pulled out a large knife, possibly a machete, and repeatedly slashed the victim’s arms and hands.

Another incident took place on November 24, around 9 a.m., in the area of 2800 Winchester Avenue. A pedestrian walking along the trail was attacked by a bicyclist wielding a large knife, resulting in cuts on the victim’s right arm and hands.

Diaz now faces charges of attempted murder, aggravated assault, and related offenses in connection with the slashing attacks.

The investigation into the Fairmount Park rape cases and the recent slashing incidents remains ongoing.
