The Austin Police Department is currently conducting an investigation into an in-custody death that occurred in south Austin. The incident took place on Monday, June 17, at approximately 4:02 p.m. when multiple 911 calls reported a disturbance at the Circle K Convenience Store located at 8801 S IH-35 Frontage Road. Witnesses described a man, later identified as 35-year-old Jermaine Sims, behaving erratically and causing a disturbance inside the store.

At 4:05 p.m., Sims proceeded to steal a pickup truck from the gas station and drove in the wrong direction on the southbound frontage road of I-35 at Slaughter Ln., resulting in a collision with several vehicles.

Law enforcement officers arrived at the scene shortly after the incident and successfully took Sims into custody. He was then transported to a local hospital by Austin-Travis County EMS, where he tragically passed away at 6:04 p.m.

Investigation Details

Following Sims’ death while in custody, the Austin Police Department has initiated an investigation into the circumstances surrounding the incident. The cause of death will be determined by the medical examiner’s office.

Footage of the event was captured on body-worn cameras worn by the officers involved, as well as a dash camera belonging to a private citizen. In adherence to APD policy, these videos will be made public within 10 business days.

The Austin Police Department will be conducting two separate investigations into the matter. A criminal investigation will be carried out by the APD Special Investigations Unit in collaboration with the Travis County District Attorney’s Office. Simultaneously, an administrative investigation will be overseen by the APD Internal Affairs Unit, with additional oversight provided by the Office of Police Oversight.
