The Bombay High Court has decided to reserve its order on a plea filed by the aunt of the minor accused in the Pune Porsche accident case. The order is set to be passed on Tuesday, June 25. The 17-year-old son of Pune-based real estate developer Vishal Agarwal is alleged to have caused the deaths of two bike-borne IT professionals, Aneesh Awadhiya and Ashwini Koshta, after hitting them while driving under the influence on May 19.

The boy, who was arrested in connection with the incident, was granted bail within 15 hours but was later taken back into custody and sent to an observation home following public outcry.

High Court’s Perspective

A division bench of the Bombay High Court acknowledged the unfortunate nature of the accident but also expressed empathy towards the minor accused, stating that he was also traumatised by the events. The court remarked, “Two people have lost their lives. There was trauma, but the child was also in trauma.”

The bench further questioned the police regarding the legal basis for amending the bail order and the subsequent confinement of the minor accused in connection with the Porsche accident case.

Legal Proceedings

The court raised concerns about the lack of application filed by the police seeking the cancellation of the bail order issued by the Juvenile Justice Board (JJB). It questioned the justification for amending the bail order and detaining the minor without proper legal procedures.

During the hearing, the court highlighted the necessity for transparency in the investigation process, emphasizing the need to adhere to the guidelines outlined in the Juvenile Justice Act.

Minor’s Aunt’s Plea

The aunt of the minor accused presented a plea before the court, alleging that the police had deviated from the correct investigative procedures, thereby undermining the principles of the Juvenile Justice Act.
