Los Angeles District Attorney George Gascón made headlines on Thursday when he announced his decision not to file charges against Ivan Gallegos, a 19-year-old USC student. Gallegos admitted to stabbing a homeless man to death after allegedly catching him trying to break into cars near the campus.
Police arrested Gallegos after the incident, where he claimed the homeless man had threatened him with a gun during the altercation. However, no weapon was found at the scene.
“We believe that Mr. Gallegos’s actions were driven by a genuine fear for his life and the lives of others,” Gascón stated.
Despite facing backlash for his lenient approach to crime, Gascón defended his decision not to press charges against Gallegos. “After careful consideration and a thorough review of all available evidence, we have decided not to pursue charges against USC student Ivan Gallegos,” he said.
Gallegos, who was scheduled for arraignment, was released from jail following the DA’s decision. The incident occurred when Gallegos and two other students encountered the homeless man, identified as Xavier Cerf, allegedly breaking into cars. The confrontation escalated, resulting in Gallegos stabbing Cerf.
“We could’ve had three dead USC students in the USC community,” said Gallegos’ friend Rafael Cardenas.
Speaking to the Los Angeles Times, Cerf’s mother, Yema Jones, described her son as a peaceful individual who struggled with mental illness. “They’re making my son out to be a person that he’s not,” she said. “He was very vibrant. He loved to dance. He wasn’t a violent kid coming up.”
The incident has sparked outrage over rising crime rates in Los Angeles and other major cities. Gascón has faced criticism for his leniency towards criminals, with victims accusing him of enabling criminal behavior by not prosecuting offenders to the fullest extent.
