Prosecutors from the 8th Judicial District Attorney’s Office initiated a 3-day reverse transfer hearing on Monday for a Greeley boy facing charges in the 2023 shooting that resulted in the death of Nasier Graham and the injury of another teenager. The hearing will determine whether the boy, who remains unnamed, will be tried as an adult or as a juvenile.

Expert Testimony and Impact Statements

Throughout the day, the 8th Judicial District Attorney’s Office called upon several witnesses to provide expert testimony. Tyler Fittz, a program manager for the Department of Youth Services’ northeast region, explained the process of how youth offenders are admitted into the system and navigate through its facilities and resources. Fittz highlighted that youth offenders sentenced to DYS face a maximum term of seven years and cannot be detained beyond the age of 21.

Sunshyne Harris, a mental health program administrator for the Colorado Department of Corrections, discussed the mental health resources available to offenders. Brian Trujillo from Youthful Offender Services explained the program’s acceptance criteria and the process of transferring offenders out.

Following the expert testimonies, victim family members were called upon to deliver impact statements. Deanna Ballesteros, the mother of the injured teenager, shared how the incident has affected her son’s physical and emotional well-being. Aubree Ballesteros, the victim’s sister, highlighted the lasting trauma caused by the event.

Heartfelt Testimonies from Victim Family Members

Family members of Nasier Graham also spoke passionately about their loss. Okema Bassett, the fiancé of Graham’s father, described Nasier as a young man with wisdom beyond his years. Frederico Graham, Nasier’s father, expressed the devastating impact of losing his son.

Continuation of the Hearing

The reverse transfer hearing is expected to continue over the next two days, with the defence team scheduled to call witnesses on Tuesday morning. The boy involved in Monday’s proceedings is one of three Greeley teenagers arrested following the shooting at the Brookstone apartment complex in January 2023.

Legal Proceedings and Sentencing

Eighth Judicial District Court Judge Daniel McDonald had previously found probable cause in the felony charges against the boy during a hearing in early May. Vincent Zamora, one of the identified suspects, has pleaded guilty to multiple felony charges and is awaiting sentencing. Another teenager involved in the case pleaded guilty to manslaughter and was sentenced to four years in the Department of Youth Services.
