Jonathan David Burr : Heights Shooting: Probation for 1, Prison for Co-Defendant

During a court session on Wednesday at the 426th Judicial District Court, Judge Steve Duskie sentenced Burr to a term of 10 years of deferred adjudication probation. As part of the sentence, Burr was ordered to write a letter of apology to the victim, according to records from Bell County court.

Court records indicate that Burr pleaded guilty on the 2nd of April.

Despite receiving a probationary sentence, Burr remains incarcerated at the Bell County Jail with a $20,000 bond on an unresolved charge of evading arrest with a vehicle, classified as a third-degree felony.

Salazar, the co-defendant, entered a guilty plea on the 25th of August, 2023. He was found guilty by Duskie and sentenced on the 21st of December, 2023, to three years in prison. Salazar is currently serving his sentence at a prison in Abilene, with a projected release date of the 9th of August, 2025, as per the Texas Department of Criminal Justice. He will be eligible for parole in August of the current year.

Police in Harker Heights responded to a shots-fired call at a residence in the 100 block of West Mockingbird Lane on the 7th of December, 2021.

Upon arrival, law enforcement officers encountered a man who appeared shaken and fearful, with a swollen arm, according to an arrest affidavit. The man informed the police that Salazar had brought another individual, later identified as Burr, to his residence.

“A physical altercation ensued between Burr and the victim, which concluded when the victim retreated into his home,” the affidavit stated. “Burr forcefully entered the victim’s home, brandishing a firearm and threatening the victim.”

According to the affidavit, a 14-year-old child present on the scene witnessed Burr pointing the firearm at the victim.

“Afterwards, Burr departed the scene and was driven away by Salazar,” the affidavit continued.

A witness informed the police that prior to their departure, Salazar fired a shot that struck a vehicle near where the witness was standing.

Another case of armed assault in Harker Heights was resolved this week within the courtrooms of Bell County.

Alicia Ann Uribe, aged 29, also known as Andy Uribe, was indicted on the 9th of June, 2021. She pleaded guilty on the 25th of April and was subsequently sentenced on Thursday at the 264th Judicial District Court. Judge Paul LePak sentenced Uribe to a term of four years of deferred adjudication probation, as per court records.

On the 17th of April, 2021, Heights police were called to a residence in the city concerning a domestic disturbance involving a firearm.

Upon arrival, officers spoke with a man who reported that his roommate, Uribe, had attempted to evict him without following the proper eviction process, threatening to shoot him, as detailed in an arrest affidavit.

The man stated that he had been living at the residence for approximately eight months.

“The victim explained that he and Uribe were in a heated argument because she wanted him to vacate the premises immediately, whereas he required a couple of weeks to make the transition,” the police report revealed. “Uribe forcefully pushed the victim out of the garage and locked the door. Following this, a verbal altercation ensued in front of the garage, during which Uribe retrieved a black pistol from inside the residence, pointed it at the victim’s head, and threatened to kill him unless he left the property.”

Police stated that Uribe’s family members intervened and pulled her back inside the house.

In an unrelated incident, a woman from Killeen has been sentenced to four years of deferred probation for assaulting a staff member of the Killeen Independent School District during a confrontation at a high school last year.

Trinity Westbrook, aged 18, was indicted on the 20th of September, 2023, on a third-degree felony charge of assault of a public servant. She entered a guilty plea on the 26th of April, according to records from Bell County court.

Judge Duskie issued Westbrook’s sentence on Friday at the 426th Judicial District Court.

On the 1st of September, 2023, Killeen police officers were called to a disturbance in a hallway at Killeen High School.

“Upon arrival, they witnessed a student identified as Trinity Westbrook shouting and behaving aggressively towards a staff member,” as per an arrest affidavit. “Following Westbrook’s apprehension, the staff member, an administrator, reported that the altercation had originated in a classroom where the victim was assisting teacher aides. Westbrook left the classroom and later returned in a state of agitation. The victim directed Westbrook to the assistant principal’s office, but Westbrook refused and proceeded to strike the victim in the face with her fist. The victim experienced pain from the impact.”

Police confirmed that two other employees witnessed the assault and provided statements to the authorities.
