The incident took place on March 9 when Dushawn Caples, a resident of Houston, heard someone stealing his vehicle from his home. Caples, reportedly armed, got into his wife’s car and pursued the thief.

As the thief and a passenger refused to stop, Caples fired shots at the stolen vehicle. Later, authorities responded to a crash on Golden Eagle Drive at around 4 a.m. A 17-year-old named Danell Cotton was found dead from gunshot wounds in the crashed car, while another man was seen fleeing the scene with a backpack.

Initially, law enforcement believed the incident to be a possible case of road rage. Caples’ wife called 911 to report the stolen vehicle, leading deputies to investigate the chain of events. Caples was subsequently charged with murder and taken into custody at the Harris County Jail. However, his attorney argued that Caples had acted in self-defense.

Sandra Guerra Thompson, a professor at the University of Houston Law Center, explained the laws surrounding the protection of property in Texas. She highlighted that Texas is the only state in the US that allows the use of deadly force to protect property. However, Thompson noted that certain factors, such as the destruction of evidence and failure to report the incident to 911, could have influenced the charges brought against Caples.

Thompson emphasized that while individuals have the right to protect their property, it does not equate to a license to kill. Texans are legally protected if they believe there is no other way to recover their property. In cases involving stolen vehicles, alternative methods of retrieval should be considered before resorting to lethal force.

Similar Incidents in the Past

Previous cases in the region have also involved deadly confrontations over stolen property. In a separate incident in February, a man was fatally shot after stealing a barbecue pit. The owner of the pit pursued the suspect in his vehicle but was not immediately charged, with the case also proceeding to a grand jury for review.

While the recent filing did not disclose further details regarding Caples’ case, his legal representative has refrained from issuing a statement on the grand jury’s decision. The outcome underscores the complex legal landscape surrounding property protection and self-defense in Texas.
