Kevin Hicks, aged 53, was supposed to appear in court on Friday for his arraignment but his attorney requested a postponement due to concerns about his ability to participate effectively in the hearing. The arraignment has now been rescheduled for Monday.
Charges Faced by Kevin Hicks
Kevin Hicks is facing charges of negligent homicide, DUI aggravated collision with serious injury, and operating a vehicle without a license. The charges stem from a collision between a Mercury Mariner driven by Hicks and a GMC Sierra in the Massabesic Street area near Valley Street.
Details of the Collision
The collision resulted in the tragic death of a passenger in Hicks’ car, identified as 50-year-old Catherine Gagne from Manchester. Two other passengers in Hicks’ vehicle sustained serious injuries, with one suffering a compound fracture to the leg. The occupants of the GMC Sierra sustained minor injuries in the crash.
Police Observations
Police officers at the scene noted that Hicks appeared unsteady on his feet and was using the car for support. When approached by an officer, the smell of alcohol was detected on Hicks as he spoke with firefighters. Hicks mentioned to the officer that he is diabetic and had taken medication for his condition.
Driving License Status
According to court documents, Kevin Hicks did not possess a valid driver’s license in New Hampshire. Although he had a license to drive in Massachusetts, it had been suspended at the time of the collision.
