13-year-old Throws 2-Year-Old from 17th-Floor Window in China

A tragic incident unfolded in Jiujiang, a city in China’s Jiangxi province, on the evening of 26th May. A 13-year-old girl with the surname Tan, who reportedly has intellectual disabilities, threw a two-year-old girl from a 17th-floor window, resulting in the toddler’s untimely death.

The victim, Qin, was playing with her grandmother on the first floor of a building complex when Tan, dressed in white, suddenly appeared. Tan then picked up Qin and carried her to the 17th floor before callously tossing her out of a window in the corridor.

Local authorities swiftly responded to the incident and took Tan into police custody. Investigations are currently ongoing to determine the circumstances that led to this heartbreaking tragedy.

Understanding the Legal Implications

On Thursday (30th May), the Public Security Bureau of Duchang County issued a statement shedding light on the events that transpired. Given Tan’s status as a minor with intellectual disabilities, legal expert Zhao Liangshan from Shaanxi Hengda Law Firm emphasized the importance of conducting a forensic evaluation to ascertain Tan’s mental state at the time of the incident.

Chinese criminal law stipulates that individuals with intellectual disabilities who are unable to recognize or control their actions may not be held criminally responsible. However, they must receive supervision from their family or guardian and undergo appropriate medical treatment.

In cases where the individual can recognize and control their behavior to some extent, they may bear criminal responsibility but with the possibility of a reduced punishment.

Qin’s family now faces the difficult task of determining how to pursue accountability for their daughter’s tragic death, considering Tan’s condition and the legal framework surrounding individuals with intellectual disabilities.
