The Genesee County Sheriff’s Department has reported that an 81-year-old homeowner is facing charges following an incident in which shots were exchanged with a deputy in the early hours of Tuesday morning.

Incident Details

At around 4:00 a.m., authorities received a call reporting a burglary at a residence on Lewiston Road in the town of Batavia. Upon responding to the call, a deputy was confronted by the homeowner, identified as 81-year-old Gregory Poole, outside the property.

Exchange of Gunfire

According to preliminary investigations, Poole allegedly fired a gunshot at the deputy despite the officer identifying himself. The deputy returned fire in self-defence, but Poole reportedly continued to shoot at the law enforcement officer.

Arrest and Charges

The deputy sought cover and called for backup, leading to Poole’s eventual arrest. Despite the exchange of gunfire, neither individual sustained any injuries from the bullets. Poole was later taken to the hospital for injuries believed to have been sustained during a physical altercation with a burglary suspect.

Legal Proceedings

Poole has been charged with Reckless Endangerment and Menacing a Police Officer. He appeared in court and was released on his own recognizance, with a scheduled court appearance set for June 11.

Search for Suspect

Following the incident, deputies conducted a search of the area but were unable to locate the suspected burglar, who is believed to have fled before the deputy’s arrival.
