CHARLESTON, WV (WOWK) — In a bold move, Disability Rights of WV have announced their intention to sue Governor Jim Justice, Attorney General Patrick Morrisey, the Department of Human Services, and its secretary, Cynthia Persily. The lawsuit is in response to the alleged concealment of documents related to the tragic death of a child in Boone County.

Allegations of Evading Accountability

The group claims that the governor’s office and the Department of Human Services have been withholding crucial documents pertaining to child abuse cases, investigations, and findings. These documents are required by federal law to be made public, but according to Disability Rights of WV, they have been kept hidden to avoid accountability.

In a strongly-worded letter, the group accuses the governor’s office and the Department of Human Services of resorting to threats of “bogus criminal charges,” covering up misconduct, retaliating against journalists and the press, and obstructing efforts for systemic reform.

Legal Action on the Horizon

The cease and desist letter sent to the individuals and departments named demands an immediate halt to any further violations of laws regarding the mandatory public disclosure of information related to the Boone County Death, child abuse cases, investigations, and findings. Failure to comply with these demands will result in Disability Rights of WV pursuing legal action against the parties involved.

Tragedy in Boone County

The lawsuit comes in the wake of the heartbreaking death of 14-year-old Kyneddi Miller in Boone County. In a chilling revelation, it was discovered that Kyneddi had been found dead in a bathroom in an emaciated state, with reports indicating that she had not received proper care for several years.

Julie Miller, Kyneddi’s mother, has been arrested and charged with child neglect resulting in death. Additionally, Kyneddi’s grandparents, Donna and Jerry Stone, have also been arrested on similar charges.

Community Shock and Disbelief

Following the arrests, neighbours of the Miller family expressed shock and disbelief at the tragic events unfolding in their community. Many were unaware of the severity of the situation and had only seen state police conducting wellness checks at the residence.

Despite the shocking revelations, neighbours described the grandparents as respected members of the community and stated that they had never suspected any neglect or abuse within the household. They believed that the family had been planning to seek help for Kyneddi before her untimely passing.
