SHENANDOAH – The borough police are awaiting a ruling on the justification of their actions in the shooting of an alleged burglar on West Coal Street late last year.

District Attorney Mike O’Pake confirmed on Monday that he has received the incident report prepared by the State Police, who conducted an investigation into the shooting on Dec. 11.

O’Pake mentioned that he is currently examining the report and anticipates making a decision on the case within this month.

According to State Police at Frackville, the authorities responded to a burglary in progress at a residence on 309 West Coal Street around 12:30 am that day, prompting the presence of Shenandoah and Mahanoy City Police.

Upon clearing the residence, law enforcement officers discovered a man, later identified as 32-year-old Byron Scheuring from Shenandoah, hiding under a bed on the upper floor.

Allegedly, Scheuring disregarded multiple commands to surrender and instead resisted the officers’ orders.

As officers attempted to move the bed Scheuring was hiding under, he reportedly lunged at them while brandishing what appeared to be a machete.

Subsequently, a Shenandoah police officer discharged a single shot, striking Scheuring, as reported by State Police at the time.
