A man from Billings has been sentenced to 20 years in prison for coercing a minor girl in New York to create and send him sexually explicit images of herself. Jeffrey Eugene Herbert, 35, admitted to charges of production of child pornography and possession of child pornography in a court hearing presided over by US District Judge Dana L. Christensen.

The sentencing also includes a lifetime of supervised release for Herbert, along with a restitution order of US$842, according to US Attorney Jesse Laslovich.

Court documents reveal that Herbert not only possessed and distributed child sexual abuse material but also used minor victims to produce material for his personal gratification.

Coercion and Threats

The case came to light in June 2022 when the parents of a 13-year-old girl, known as Jane Doe 1, in New York reported to law enforcement that their daughter had been coerced into producing child sexual abuse material online through a social media platform.

An investigation into Jane Doe 1’s phone revealed that she had exchanged almost 900 communications with a user going by the name “amberbaby 14141” during that month. It was later discovered that the user, who turned out to be Herbert, had been posing as a 14-year-old girl and soliciting sexually explicit content from Jane Doe 1.

To obtain more material, Herbert resorted to coercion and threats, including threatening to share the videos with others and disrupt the girl’s life.

Investigation and Discovery

Law enforcement officials executed a search warrant at Herbert’s residence in October 2022, seizing electronic media. During an interview with authorities, Herbert confessed to using the “amberbaby 14141” account to coerce underage girls into creating sexually explicit content.

Herbert directed law enforcement to where child sexual abuse material was stored on his phone, leading to the discovery of a hidden application with folders named after victims. Investigators identified potentially 22 minor victims, with the content comprising hundreds of videos and images of minors from various locations producing child sexual abuse material at Herbert’s direction.

Prosecution and Investigation

Assistant US Attorney Zeno B. Baucus handled the prosecution of the case, which was investigated by the FBI and Montana Division of Criminal Investigation.

The case was part of Project Safe Childhood, an initiative launched by the Department of Justice in 2006 to combat child sexual exploitation and abuse. Project Safe Childhood aims to locate, apprehend, and prosecute individuals who exploit children online, as well as identify and rescue victims.
