The Special Court for SC/ST (Prevention of Atrocities) Act Cases, Kottarakkara, has handed down a rigorous life imprisonment sentence to a 39-year-old man convicted of raping a woman from the Scheduled Caste (SC) community. The perpetrator, identified as Viswambharan from Vettikkavala, Kollam, committed the crime on October 22, 2017.
The victim, a 40-year-old woman who is uneducated and malnourished, was attacked while she was cutting grass for her goats near her residence by a canal. The heinous act of sexual assault was met with strong condemnation from the judge, who emphasized the severity of the offence.
Sentencing Details
In addition to the life term imposed under Section 3(2)(v) of the SC/ST (POA) Act, the Special Judge R. Jayakrishnan sentenced the perpetrator to 10 years of rigorous imprisonment under Section 376 (1) (rape) of the Indian Penal Code. Furthermore, a one-year rigorous imprisonment term was given under Section 3(1)(w) (i) of the SC/ST (POA) Act. These sentences are to be served concurrently.
The judge, in delivering the verdict, stated that the accused showed no remorse and therefore deserved no leniency. The crime committed against the vulnerable victim was described as a societal evil that must be addressed with utmost seriousness.
Compensation and Fine
As part of the judgement, the convict was ordered to pay a fine of ₹1.1 lakh. Should the fine not be paid, the perpetrator will face additional time behind bars. The amount collected from the fine is intended to be given to the survivor as compensation, as per the court’s directive. The judge also highlighted that the victim is entitled to compensation under the Victim Compensation Scheme.
The case was originally reported to the Kottarakkara police station, with Special Public Prosecutor G.S. Santhosh Kumar representing the prosecution during the trial.
