A man who blended his sperm with his father’s in order to assist his partner in conceiving a child has been exempted from undergoing a paternity test, according to a ruling by the high court.

The man, referred to as PQ due to legal restrictions, and his partner JK, experienced fertility issues and were unable to afford in vitro fertilization (IVF) treatment. During a hearing last month, it was revealed that they decided to combine PQ’s sperm with his father’s (RS) and inject it into JK. The couple intended to keep this arrangement a secret, resulting in the birth of their now five-year-old son, D.

However, Barnsley council became aware of the circumstances surrounding the child’s conception through separate proceedings and subsequently initiated legal action to determine his parentage.

The council requested the high court in Sheffield to order DNA tests to establish whether PQ was D’s biological father.

Nevertheless, Justice Poole dismissed the council’s request in a judgement delivered on Thursday, stating that the council had no vested interest in the outcome of the case.

Justice Poole stated, “While the council may desire to know who D’s biological father is, it does not have a personal stake in this application. A desire to uphold the public interest in maintaining accurate birth records does not grant a personal interest in the resolution of this matter.”

The judge concluded that the family may choose to undergo a paternity test in order to inform the child at a later stage, but emphasized that this decision would be left to them.

Throughout the proceedings, the judge highlighted that the family had “created a welfare minefield,” and expressed doubt that JK, PQ, and RS had fully considered the potential consequences of their plan for JK to become pregnant.

The judge further remarked that the boy “is a unique child who would not exist if it weren’t for the unconventional arrangements made for his conception. However, these arrangements also carry the potential for emotional harm should he discover them.”

Justice Poole acknowledged that the man had an established father-and-son relationship with the child, and stated that managing potential risks to the child’s well-being was the responsibility of the man and the boy’s mother.

He added, “It must be recognized that the circumstances surrounding D’s conception cannot be undone. Without testing, his biological paternity remains uncertain, but there is a strong likelihood that the person he believes to be his grandfather is, in fact, his biological father, and the person he believes to be his father is his biological half-brother.”
