NEW YORK (AP) — Shocking video footage released late Saturday reveals the heartbreaking moment when an officer in upstate New York fatally shot a 13-year-old boy who had been tackled to the ground after fleeing from the police and brandishing a replica handgun at them.

The tragic incident took place a little after 10 p.m. Friday in Utica, a city located approximately 240 miles (400 kilometers) northwest of Manhattan. The officers stopped two youths in connection with an armed robbery investigation, both aged 13, who matched the descriptions of the robbery suspects and were in the vicinity at the same time. One of the youths was also in violation of state traffic laws by walking in the road.

The body camera footage released by the police captures the moment when one of the youths, identified as Nyah Mway, attempts to flee upon the officers’ request for a pat-down to check for weapons. During the pursuit, Nyah Mway is seen pointing the replica handgun at the officers, leading to the fatal outcome.

Replica Gun Misidentified as Real Weapon

Authorities initially believed the replica gun to be a real handgun, later identified as a replica of a Glock 17 Gen 5 with a detachable magazine that only fires pellets or BB’s. Despite this, the officers perceived it as a genuine threat, resulting in the tragic shooting.

Following the confrontation, one of the officers, identified as Patrick Husnay, a six-year veteran of the agency, fired a single shot that struck Nyah Mway in the chest. Despite immediate first aid efforts by the officers and transportation to Wynn Hospital, Nyah Mway tragically succumbed to his injuries.

Community Outcry and Investigation

The incident, which has deeply unsettled the community of Utica, where over 4,200 people from Myanmar have found refuge, has sparked a public outcry. Nyah Mway, a refugee born in Myanmar and a member of the Karen ethnic minority, was a student at Donovan Middle School and tragically lost his life in the encounter.

The police department has initiated an internal investigation to assess whether the officers adhered to protocols and training procedures. Additionally, the state attorney general will conduct an independent inquiry to determine the justification of the shooting.

Utica Police Chief Mark Williams expressed his condolences to the family of Nyah Mway, acknowledging the tragic and traumatic nature of the incident for all parties involved.
