A new video released today has revealed the tragic incident in which a 13-year-old boy was fatally shot by an officer in upstate New York. The incident occurred in Utica, a city located about 400 kilometres northwest of Manhattan, after the teen had been tackled to the ground following a chase by the police. The boy, identified as Nyah Mway, had pointed a replica handgun at the officers before being shot.

The events unfolded a little after 10pm on Friday when officers stopped two 13-year-old youths in connection with an armed robbery investigation. Both youths matched the descriptions of the robbery suspects and were in the same area as the crime. One of them, Nyah Mway, was also walking in the road, which was a violation of state traffic law.

The body camera footage released by the police captures the moment when Nyah Mway attempts to flee from the officers. In the video, he is seen pointing the replica gun at the pursuing officers, prompting one of them to open fire. The officers believed the weapon to be a real handgun, but it was later determined to be a replica of a Glock 17 Gen 5 handgun with a detachable magazine.

Utica Police Chief Mark Williams stated that during a struggle on the ground, one of the officers fired a single shot that tragically struck Nyah Mway in the chest. Despite receiving immediate first aid from the officers, the teen succumbed to his injuries at Wynn Hospital.

Lieutenant Michael Curley, a police spokesperson, described the replica gun carried by Nyah Mway as “in all aspects a realistic appearing firearm with GLOCK markings, signatures, detachable magazine, and serial numbers.” However, the weapon only fires pellets or BB’s.

Chaotic Scene Unfolds

The bystander video posted on Facebook captures the chaotic scene as one of the officers chases Nyah Mway and tackles him to the ground. The video also shows the officer punching the teen as two other officers arrive at the scene. A gunshot is heard as Nyah Mway is on the ground, and the officers quickly stand up.

The officer who discharged his weapon, identified as Patrick Husnay, along with Officers Bryce Patterson and Andrew Citriniti, were placed on administrative leave with pay following the incident.

The body camera footage reveals a tense moment as Nyah Mway points the replica handgun at the officers while attempting to flee. The officers shout “gun!” to each other as they give chase. Patterson tackles and punches Nyah Mway, and as they grapple on the ground, Husnay fires his weapon.

Following the shooting, officers initially thought that Nyah Mway had shot himself, leading to confusion during the chaotic scene. Bystanders can be heard screaming at the police throughout the recordings, while an officer responds, “We’re trying to save him right now!”

Community Outcry and Investigation

The shooting has stirred public outcry in Utica, a city with a population of 65,000, and home to a significant number of refugees from Myanmar. Nyah Mway, a refugee born in Myanmar and a member of the Karen ethnic minority, was an 8th grader at Donovan Middle School, according to local reports.

Karens are an ethnic minority group in Myanmar who have been involved in the conflict with the country’s military rulers. The army seized power from the elected government in 2021 and has since cracked down on protests calling for a return to democracy.

Utica Mayor Michael Galime, along with city officials and an interpreter, tried to address the community’s concerns at a news conference, which ended abruptly due to audience disruptions. The police department is conducting an internal investigation to determine if officers followed proper protocols and training, while the state attorney general will also review the case to assess the justification of the shooting.

In a public statement, Chief Williams expressed his condolences to the family of Nyah Mway, acknowledging the tragedy of the incident. “This is a traumatic event for all involved,” he said.
