NEW YORK — (AP) — Shocking video footage released late Saturday has revealed the tragic shooting of a 13-year-old boy by an officer in upstate New York. The incident occurred after the boy, identified as Nyah Mway, was tackled to the ground following a chase by police officers, during which he pointed a replica handgun at them.

The fatal shooting took place a little after 10 p.m. on Friday in Utica, a city located approximately 240 miles (400 kilometers) northwest of Manhattan. According to police reports, the officers had stopped two youths in connection with an armed robbery investigation. Both youths, aged 13, matched the descriptions of the robbery suspects and were in the same area at the time of the incident. One of them was also found to be in violation of state traffic laws for walking in the road.

The body camera footage released by the police captures the moment when Nyah Mway attempts to flee from the officers. In the video, Nyah is seen pointing the replica handgun at the pursuing officers before being tackled to the ground. The officers believed the weapon to be a real handgun, but it was later determined to be a replica of a Glock 17 Gen 5 handgun with a detachable magazine.

Officer’s Response and Tragic Outcome

During the struggle on the ground, one of the officers, identified as Patrick Husnay, fired a single shot that tragically struck Nyah Mway in the chest. Despite receiving immediate first aid from the officers and being taken to Wynn Hospital, the young boy succumbed to his injuries.

Lt. Michael Curley, a police spokesperson, confirmed that the replica gun carried by Nyah Mway closely resembled a real firearm, complete with GLOCK markings, signatures, detachable magazine, and serial numbers. However, the weapon only fires pellets or BB’s.

Following the incident, Officer Husnay, along with Officers Bryce Patterson and Andrew Citriniti, were placed on administrative leave with pay. The police department is conducting an internal investigation to determine whether the officers followed proper protocols and training.

Community Outcry and Investigations

The release of the body camera footage has sparked outrage in the community, particularly among the family and friends of Nyah Mway. The shooting has raised questions about police procedures and the use of force, prompting calls for an independent investigation.

Utica, a city with a population of 65,000, is home to a significant number of refugees from Myanmar, including Nyah Mway, who was a member of the Karen ethnic minority. The Karen people have been involved in ongoing conflicts with the military rulers of Myanmar, following the ousting of the elected government in 2021.

In response to the public outcry, Utica Police Chief Mark Williams expressed his condolences to the family of Nyah Mway and acknowledged the tragic nature of the incident. The state attorney general will be opening an independent investigation to determine the justification for the shooting.

This heartbreaking incident has once again raised concerns about police practices and the need for accountability in law enforcement. The community is demanding transparency and justice for Nyah Mway and his family, as they grapple with the loss of a young life cut short.
