NEW YORK | Video footage released late Saturday reveals a tragic incident in upstate New York where a 13-year-old boy was fatally shot by an officer after fleeing from the police and pointing a replica handgun at them.

The shooting took place a little after 10 p.m. on Friday in Utica, a city located approximately 240 miles northwest of Manhattan, following a stop by officers in connection with an armed robbery investigation.

According to the police, the two youths, both 13, matched the descriptions of the robbery suspects and were in the same area at the same time as the incident. One of the youths was also found to be violating state traffic laws by walking in the road.

Body camera footage released by the police captures the moment when one of the youths, identified as Nyah Mway, ran away as an officer attempted to pat them down for weapons. The video shows Nyah Mway pointing what appeared to be a handgun at the pursuing officers, prompting one of them to open fire.

Although the officers believed the weapon was a real handgun, it was later confirmed to be a replica of a Glock 17 Gen 5 handgun with a detachable magazine.

Following a struggle on the ground, one of the officers fired a single shot that tragically struck the boy in the chest. Despite immediate first aid efforts, the teen succumbed to his injuries at Wynn Hospital.

The replica gun carried by the teen closely resembled a real firearm, complete with GLOCK markings, detachable magazine, and serial numbers. However, it only fired pellets or BB’s, according to Lt. Michael Curley, a police spokesperson.

The officer who discharged his weapon was identified as Patrick Husnay, a six-year veteran of the agency. He, along with Officers Bryce Patterson and Andrew Citriniti, were placed on administrative leave with pay pending further investigation.

The incident, captured on police body cameras, depicted a chaotic scene with officers and the fleeing teen. The footage shows Nyah Mway pointing the replica handgun at the officers while running, leading to the fatal shot being fired.

Following the shooting, a tense news conference was held in Utica, where community members, including the youth’s family, were present. The police department is conducting an internal investigation to determine if officers followed protocols and training, while the state attorney general will also review the case to ascertain the justification of the shooting.

Utica, a city with a population of 65,000, has been deeply affected by the incident, particularly given Nyah Mway’s refugee background. Reports indicate that Nyah Mway was an 8th grader at Donovan Middle School and a refugee born in Myanmar, belonging to the Karen ethnic minority.

The Karen ethnic group has been involved in conflicts with the military rulers of Myanmar, following the ousting of the elected government in 2021. The community in Utica, including refugee organizations, has expressed shock and grief over the tragic loss.

Utica Police Chief Mark Williams expressed his condolences to the family of the deceased, acknowledging the traumatic nature of the incident for all involved. The investigation into the shooting continues, with authorities committed to a thorough review of the events leading up to the fatal shooting.
