The controversy arose when his family was denied a private autopsy to determine the cause of his death.
Dr. Naged Megally, a specialist in foetal medicine at Mater Dei Hospital, tragically passed away on 5 July 2023, after experiencing medical complications. Megally had been admitted to the hospital in May and was in intensive care, undergoing multiple surgeries. Despite initial signs of recovery, his condition took a turn for the worse, leading to his untimely demise. The cause of death was later identified as a condition affecting his windpipe.
Following his passing, Dr. Megally’s widow, son, and two daughters repeatedly requested an autopsy to shed light on the circumstances surrounding his death. However, their requests were met with delays and obstacles. Initially, the hospital agreed to conduct an autopsy but failed to provide the necessary documents for the family to sign, leaving them suspicious of potential negligence.
In a bid to uncover the truth, the family sought a magisterial inquiry, prompting a police report and involvement of the duty magistrate. Despite their efforts, the magistrate declined to initiate an inquiry due to the issuance of the death certificate. Undeterred, the family continued to push for an autopsy, emphasizing the need for a thorough investigation within the framework of a magisterial inquiry.
Faced with roadblocks at every turn, the family took their case to the First Hall, Civil Court in its constitutional jurisdiction. The lawsuit targeted Mater Dei Hospital’s CEO, the Superintendent of Public Health, and the Health Minister, alleging that their rights had been infringed upon. After thorough deliberation, the Court ruled in favor of the family, holding the hospital CEO and the Superintendent of Public Health accountable for breaching their right to privacy and family life.
As a result of the court’s decision, Mater Dei Hospital’s CEO and the Superintendent of Public Health have been instructed to grant authorization for the autopsy to proceed. The autopsy will be conducted at Mater Dei Hospital within 15 days by two pathologists chosen by the family from a list of approved specialists. Additionally, a third pathologist will act as an observer, selected by the hospital.
While the family has already paid a deposit for the autopsy, they have been ordered to cover a quarter of the legal expenses. Notably, the court did not award any compensation for damages to the family. The ruling also stipulates a shortened appeal period of five days.
