An 18-year-old woman from Denton is taking legal action against a popular Latin nightclub in downtown Dallas after she claims she was sexually assaulted on the premises in December. The lawsuit, filed last week, alleges that Club VIVO created an environment that facilitated the assault and that the security staff failed to intervene despite being alerted by the victim’s friend.
The plaintiff’s attorney, Charla Aldous, stated, “They’re basically creating an environment perfect for predators. They allow these young girls to come in, they pour alcohol into them and then they stand by and do nothing when older men attack them.”
Legal Allegations
The legal complaint argues that Club VIVO’s marketing campaigns and atmosphere attract older men who exploit intoxicated and vulnerable underage girls. The lawsuit claims that the nightclub’s staff serve alcohol to underage patrons, including the victim, despite being aware of their age.
The victim, identified as Jane Doe in the legal filings, is a college student. She was permitted entry into the nightclub with a visible “X” marking her as underage. Despite this, she was served alcohol and subsequently assaulted by an unknown man in an upstairs restroom.
During the assault, the victim managed to text her friend for help, but when the friend informed the security staff, they allegedly did not intervene.
Legal Action and Police Report
The woman is suing Club VIVO for negligence, liability, and for violating a section of the state’s alcoholic beverage code that allows legal action against establishments that over-serve alcohol to patrons who pose a danger to themselves or others.
Following the assault, the victim reported the incident to the Dallas Police Department. The investigation is ongoing, according to her legal representatives.
