A resident of Spicer, Minnesota, Edward Timothy Russell, has been sentenced to more than 14 years in prison for first-degree criminal sexual conduct after entering a neighbor’s home in the middle of the night. The 30-year-old Russell pleaded guilty to the charge on June 3 and received the statutory maximum sentence of 172 months on the same day.
Russell’s guilty plea was part of a Norgaard plea, where the defendant claims a loss of memory regarding the offense but agrees that there is sufficient evidence for a conviction. In exchange for the plea, three other felony charges and an unrelated misdemeanor case were dismissed. The prosecution withdrew its motion for a more severe sentence, and Russell agreed to the maximum sentence under guidelines.
Details of the Assault
The criminal complaint states that Russell was identified as the suspect in the sexual assault of a 90-year-old woman in her Spicer residence. The woman reported that she was attacked in the middle of the night, with the assault involving sexual penetration and the use of force.
Following the assault, evidence was collected from the woman’s residence, and she underwent a medical examination to gather further evidence. Subsequent DNA testing linked Russell to the crime, leading to his arrest and eventual guilty plea.
Sentence and Release
Under Minnesota law, Russell will be required to serve at least two-thirds of his sentence in custody. His expected release date from the Minnesota Correctional Facility in St. Cloud is May 31, 2033, with credit given for time already served. Additionally, Russell will have to register as a predatory offender and serve a 10-year conditional release period after his prison term.
