Accident – Death – Obituary News : Abdullah Arif’s spouse revealed in court that the couple fled Iraq to escape the pervasive violence and senseless killings of innocent adults and children. Their journey to America was motivated by a quest for peace and the opportunity to build a new life, Maeda Obaidi shared during her testimony on Friday.
According to Obaidi, Arif dedicated himself to mastering the English language and obtaining U.S. citizenship. She expressed gratitude for his efforts in providing for her and their children, ensuring their safety in their new homeland. The couple harbored hope and aspirations of thriving in America.
Tragically, Arif was brutally taken from them by Elias-Kareem Hany Aly, who fatally shot the 48-year-old father of four during a confrontation at Union Tobacco on St. Paul’s West Side, where Arif worked part-time. The devastating loss left his wife bereft of her soulmate, and their children without the love and care of their devoted father.
In a sentencing hearing presided over by Ramsey County District Judge David Ireland, Aly, a 22-year-old resident of St. Paul, received a prison term of 13 years and nine months for the murder. Despite a plea from Aly’s attorney for a reduced sentence below the state guidelines, the judge upheld the recommended range of nearly 12 to 16½ years.
Aly entered a straight guilty plea to second-degree unintentional murder in February, leading to the dismissal of an intentional murder charge during sentencing. The fatal encounter occurred after Arif confronted Aly and his companions inside the store, demanding that Aly remove a mask covering his face. As Aly departed, he tampered with a door chime, prompting Arif to confront them outside with a baseball bat. Tragically, Aly shot him once, fatally injuring him.
Prior to the fatal shooting, Aly was present at the same courthouse for a hearing related to a June 2020 gross misdemeanor charge of possession of a firearm by an ineligible person. Despite being on conditional release following a $200,000 bond posted in connection with a drive-by shooting in Maplewood, Aly violated the terms of his probation by committing the heinous act that claimed Arif’s life.
Following his murder sentencing, Aly pleaded guilty in a separate hearing to possession of a firearm by an ineligible person in connection with the drive-by shooting. Judge Ireland imposed a concurrent five-year prison term for this offence, to run alongside Aly’s murder sentence.
The fatal incident at Union Tobacco unfolded on the afternoon of February 16, 2023, when St. Paul police responded to reports of a shooting. They found Arif with a gunshot wound to the chest, and he was pronounced dead upon arrival at Regions Hospital. Surveillance footage from the store captured the events leading up to the tragedy, showing Aly and his associates entering the premises, with Aly wearing a mask that Arif requested he remove. Despite attempts by store employees to de-escalate the situation, the confrontation escalated outside, culminating in the fatal shooting of Arif.
In a bid to secure a reduced sentence, Aly’s attorney contended that Arif had acted as the aggressor in the altercation, prompting Aly to act out of fear. However, Assistant Ramsey County Attorney Wesley Abrahamson disputed this claim, highlighting the lack of imminent danger to Aly and his friends within the vehicle. In his remorseful statement to the court, Aly acknowledged the gravity of his actions, expressing regret for the irreversible harm he caused to Arif’s family.
Judge Ireland ultimately rejected the plea for a reduced sentence, emphasising the gravity of Aly’s actions and the consequences of his choices. Despite Arif’s role in the altercation, the judge deemed the circumstances insufficient to warrant a departure from the prescribed sentencing guidelines..
