Accident – Death – Obituary News : A resident of Freeman who was accused of a serious sex crime has entered a guilty plea in a Yankton courtroom this week. Shawn Michael Wuebben, aged 23, has admitted to a felony charge of first-degree rape involving a victim under the age of 13. The plea agreement, signed prior to the court hearing, also included a detailed confession by Wuebben regarding the sexual act committed against a child.

The victim, identified as K.A. in court records, was only 10 years old at the time of the offence, which took place between July 1 and December 22, 2022. Judge Cheryle Gering informed the defendant of the legal ramifications of his guilty plea, which could result in a sentence ranging from 15 years to life imprisonment, along with a potential fine of $50,000. Additionally, Wuebben will be required to undergo treatment, register as a sex offender, and provide financial restitution for any counselling required by the victim for the rest of her life.

Following his indictment by a grand jury on February 5, Wuebben was arrested on a warrant and has since been held in Yankton County Jail on a $100,000 cash-only bond awaiting trial. A mental health competency evaluation was ordered early in the legal proceedings in response to a motion by defense counsel Garrett Horn, who considered alternative pleas based on mental health grounds. However, the evaluation conducted in late May deemed Wuebben competent to stand trial.

On June 6, the results of the mental health evaluation were presented in court, where Wuebben initially pleaded not guilty, and a trial was scheduled for the coming months. Nevertheless, by entering a guilty plea this week, Wuebben has waived his right to a trial and will proceed directly to sentencing. Judge Gering has also ordered a psychosexual evaluation to be completed prior to sentencing, which may lead to a delay in the sentencing process until October or November.

Wuebben is not expected to appear in court again until his sentencing hearing on November 26. This case has raised awareness about the severity of sex crimes and the legal processes involved in such cases, emphasizing the importance of justice and accountability in safeguarding vulnerable individuals in society..
