A 60-year-old man in Arizona was arrested for allegedly murdering his wife and mother-in-law barely a week after his wife filed for divorce.

Richard McGrath was taken into custody on Tuesday and charged with two counts of premeditated first-degree murder, two counts of aggravated assault, two counts of kidnapping, and one count each of armed robbery and burglary in the slayings of 53-year-old Marcia McGrath and 77-year-old Thea Merlino, records reviewed by Law & Crime show.

According to a probable cause affidavit, deputies with the Maricopa County Sheriff’s Office at about 3:07 a.m. on Tuesday responded to an emergency call regarding an armed male at an apartment complex in the area of 111th Avenue and Newcastle Drive.

The complainant told the emergency dispatcher that they and another person heard a “loud banging noise” from the apartment upstairs and were concerned that someone may have fallen down.

“The complainants grabbed their cell phone and started walking up the stairs to the second-story apartment to perform a welfare check when they noticed the front door of the upstairs apartment was open,” the affidavit states. “Around that same time, a white male subject wearing all dark clothing and gloves emerged from the apartment with the open door, and was holding a black handgun.”

The armed man — later identified as Richard McGrath — instructed the complainants to lie down on the ground, threatening to shoot them if they moved. The gunman then confiscated a cellphone from one of the complainants.

When the gunman re-entered the apartment, the complainants retreated back down to their apartment and dialed 911. As they were leaving, the gunman threatened to harm them again, according to the complaint.

Upon arrival at the scene, first responders discovered the front door of the women’s apartment unit already open. Inside, they found two adult females — later identified as Marcia McGrath and Thea Merlino — suffering from what appeared to be gunshot wounds. Merlino was pronounced dead at the scene, but her daughter was still alive when authorities arrived and implicated her husband as the perpetrator.

“Before this female passed away, (Marcia McGrath) made statements to MCSO deputies while they were providing medical attention to her on the scene that her ex-husband ‘Robert McGrath’ was the individual who shot her,” the affidavit states. “She continued to state, ‘I’m divorced’ and ‘he lives in El Mirage.’”

Marcia McGrath was declared dead shortly after arriving at a hospital.

When deputies visited Robert McGrath at his home in El Mirage, they allegedly discovered bullets of the same caliber used to kill his wife and mother-in-law. During the interview, detectives said McGrath mentioned “about being prescribed sleep medication and at the time of the interview, being under the effects of the prescribed sleep medication.”

He was apprehended at his home and transported to Maricopa County Jail where he is currently detained on a £2 million cash-only bond. He is set to appear in court on July 5.

According to a report from Phoenix CBS affiliate KTVK, Marcia McGrath filed for divorce from her husband on June 17.
