Buffalo Man Facing Charges for Burglary and Lewd Conduct Arraigned in Court.

In Buffalo, NY, a 26-year-old man, Orlando Martinez, Jr., is facing serious charges after allegedly following and harassing a 62-year-old woman in her apartment building and committing lewd acts in Buffalo stores. Acting Erie County District Attorney Michael J. Keane announced that Martinez was arraigned on Friday afternoon before Buffalo City Court Judge Phillip Dabney, Jr. on charges including Burglary in the Third Degree, Public Lewdness, Harassment in the Second Degree, and Trespass.

Alleged Incident in Apartment Building

On Saturday, June 15, 2024, at approximately 10:00 p.m., it is alleged that Martinez followed the 62-year-old victim as she entered her apartment building on Delaware Avenue in Buffalo. Martinez then unlawfully entered the victim’s apartment building, followed her into an elevator and hallway, exposed himself, committed a lewd act, and fled the building. The victim reported the incident to the police.

Charges in Buffalo Stores

It is further alleged that on Tuesday, May 28, 2024, Martinez entered a store on the 500 block of West Delavan Avenue and exposed himself, committing a lewd act in the presence of an employee. Later that same evening, Martinez went to a store on the 900 block of Elmwood Avenue, exposed himself, and committed a lewd act in front of multiple patrons. The store employee reported the incident to the police.

Court Proceedings and Bail

Martinez is scheduled to return for a felony hearing on Thursday, July 18, 2024. Prosecutors requested that he be remanded for allegedly committing a misdemeanor sex offense while released on a pending case involving a similar offense. Martinez remains held on bail set at $3,500 cash or $50,000 bond, with a temporary order of protection issued for the victim.

If convicted of the highest charge, Martinez faces a maximum sentence of 7 years in prison. The case is being prosecuted by Assistant District Attorney Meredith M. Mohun of the Special Victims/Domestic Violence Bureau.

Presumption of Innocence

As with all individuals accused of a crime, Martinez is presumed innocent until proven guilty in a court of law. Acting DA Keane commended the Buffalo Police Department Special Victims Unit for their work in the investigations.
