LAS VEGAS (KTNV) — A federal court has approved a $9.95 million settlement after a family sued the Clark County School District over abuse claims.
The lawsuit, filed in 2019 by parents of a student identified as J.W., alleged that the child, who is non-verbal and autistic, was subjected to abuse at Harley Harmon Elementary School between 2016 and 2018.
According to court documents, the family raised concerns about their son’s well-being, including issues with food, water, and hygiene, but were allegedly ignored and mistreated by school officials.
In May 2018, a substitute aide reported witnessing J.W.’s teacher, Melody Carter, physically and verbally abusing the child. The incident led to Carter’s arrest on a felony child abuse charge.
Despite the arrest, the Clark County District Attorney’s Office later considered reducing the charge to a misdemeanor, which was eventually dismissed after Carter agreed to attend anger management classes.
J.W.’s parents claimed they were not informed about the full extent of the abuse until years later, prompting them to file the lawsuit against the school district.
After years of legal battles, the United States District Court in Nevada approved the $9.95 million settlement between the family and CCSD.
Gregg Hubley of Arias Sanguinetti, the family’s legal representation, expressed gratitude for the settlement but emphasized the lasting trauma and pain endured by J.W. and his parents. He called for the district to implement measures to prevent similar incidents in the future.
Channel 13 contacted CCSD for a statement regarding the settlement but has not received a response at the time of publishing.
