ALBION — A Ligonier man who was convicted by a Noble County jury of child molesting is set to be sentenced at 2:30 p.m. on July 15 in Noble Circuit Court.
The jury found J. Flelix Malagon, 82, guilty of three counts of child molesting, each classified as a Level 1 felony, as well as a single count of child molesting, classified as a Level 4 felony, after a four-day trial that concluded on Thursday, June 13.
After the conviction, Circuit Court Judge Michael Kramer ordered a pre-sentence evaluation report for Malagon.
Court documents revealed that the case stemmed from a mother bringing her daughter, who is under the age of 12, to the Ligonier Police Department on Sept. 25, 2020. The daughter disclosed during a prior doctor visit that a man she identified as Felix had subjected her to a sex act.
The mother reported that the daughter also disclosed that Malagon had attempted to engage in further sexual acts with her, including attempting to penetrate her genital and anal areas. The victim further described sex toys that Malagon had in his RV, which was parked at his residence on Smith Street in Ligonier.
During an interview with police, Malagon denied the allegations, claiming that the victim had only been in his RV once and that her sister had never entered the trailer. However, a search warrant executed on Malagon’s phone yielded incriminating evidence, including photographs of the girls inside the RV and a picture of one of the sex toys identified by the victim.
According to the victim’s allegations, Malagon would pay her to keep quiet about the abuse after each incident.
The case has shocked the local community and raised awareness about the importance of protecting children from sexual abuse.
