Gabereile Ferreira : “Ex-DYA Detainee Accused of Assault Undergoes Evaluation”

An 18-year-old former Department of Youth Affairs detainee, Gabereile Ferreira, appeared in the Superior Court of Guam before Presiding Judge Alberto Lamorena III on Tuesday morning to face criminal sexual conduct charges.

The charges against Ferreira stem from allegations made by a 14-year-old boy, claiming that Ferreira and co-defendant Timo-Ju Daniel Palik sexually assaulted him while all three were detained at DYA.

During the court hearing, Ferreira’s attorney, Terrence Timblin, informed Judge Lamorena that he had filed a motion requesting for Ferreira to undergo a mental health examination. The judge subsequently ordered Ferreira to undergo the evaluation, with no objections raised by the Office of the Attorney General.

Ferreira’s next court appearance is scheduled for June 28, where further developments in the case are expected to be discussed.

As for co-defendant Palik, Judge Lamorena mentioned that he is set to return in August to ascertain whether Palik and his legal representative have been presented with a plea offer.

According to details outlined in a Superior Court of Guam magistrate’s complaint, the incidents involving Ferreira and Palik occurred after a complaint was lodged with the Guam Police Department on November 9, 2023, by the 14-year-old victim. The accuser alleged that he was sexually assaulted by the two other detainees while under DYA’s custody.

The complaint specified that Ferreira, who was around 17 or 18 years old at the time, and Palik, aged 18 or 19, were identified as the suspects by the victim. Both individuals were former detainees at DYA, as per the complaint.

It was reported in the complaint that Ferreira attempted to sexually assault the 14-year-old on multiple occasions, including following the victim into a restroom and coercing him into compromising situations. In another distressing incident, Ferreira and Palik jointly engaged in assaulting the victim, leaving him in a vulnerable and traumatised state.

The complaint further detailed how Ferreira and Palik allegedly threatened the victim to remain silent about the assaults, instilling fear and intimidation in the young boy.
