Accident – Death – Obituary News : WACO, Texas (KWTX) – The lawsuit brought by the parents of a former Lorena pre-K student who was sexually abused by her teacher is gaining momentum in Waco’s federal court. Lorena school officials and the principal named in the suit have submitted their initial public responses to the accusations in what is referred to as a Rule 26 report. This report serves as a guide for the court to manage the timing and direction of the lawsuit.

In the Rule 26 report, Lorena ISD officials have refuted claims that they turned a blind eye or took actions that facilitated former substitute teacher Nicolas Scott Crenshaw’s abuse of a 5-year-old girl in his classroom during the 2020-2021 school year. The parents of the girl, known as Jane Doe in the lawsuit, filed the lawsuit against Lorena ISD and Lorena Primary School Principal April Jewell in August after their daughter was abused by Crenshaw.

Crenshaw, a long-term substitute teacher, pleaded guilty in May 2023 to charges of aggravated sexual assault of a young child, continuous sexual abuse of a young child, and indecency with a child by contact in relation to the abuse of Jane Doe and her 4-year-old classmate. He was sentenced to 40 years in prison and is not eligible for parole.

In their responses to U.S. Magistrate Jeffrey C. Manske’s inquiries in the Rule 26 report, Lorena ISD officials have denied the allegations, while Jewell maintains that she is entitled to qualified immunity and is appealing a ruling that she is not.

The district’s response stated, “Nicolas Crenshaw committed ‘unspeakable evil’ acts against Jane Doe, but his actions are not attributable to the District and its employees. Lorena ISD did not ‘look the other way’ or take any actions that made it easier for Crenshaw to commit his crimes against Jane Doe.”

Jewell’s pending appeal with the 5th U.S. Circuit Court of Appeals has put a hold on further proceedings, including discovery, until the appeal is resolved. However, Manske has set discovery to commence on July 1 and scheduled a trial date for October 6, 2025.

The lawsuit alleges that the girl suffers from post-traumatic stress syndrome, physical pain, anxiety, anger, nightmares, fear, and distrust of others as a result of the abuse. The suit also claims that Jewell and other administrators facilitated Crenshaw’s actions and retaliated against employees who reported his inappropriate conduct.

After the school district’s attorneys responded to the Rule 26 report, the Lorena ISD Board of Trustees released a statement to families in the district, emphasizing the importance of trust and patience during the legal process.

The Does allege in the lawsuit that Lorena ISD violated Title IX requirements by showing “deliberate indifference” to the abuse reports, hindering the girl’s educational opportunities. The lawsuit also alleges failures in training, supervision, policies, and executive actions by the school district and Jewell.

As the legal proceedings continue, the community awaits further developments in this case that has raised concerns about child safety and accountability within educational institutions..
