On June 17, an Albuquerque man, Manuel Gutierrez, aged 29, has been accused of shooting at a Walmart employee in Northeast Albuquerque last month. Witnesses informed the police that the employee had allegedly shot at Gutierrez and two other men prior to the incident. Gutierrez is facing charges of aggravated assault with a deadly weapon, tampering with evidence, and negligent use of a deadly weapon. He is currently detained at the Metropolitan Detention Center with no response from his attorney.

A warrant has been issued for Elias Sisneros, aged 25, who is also implicated in the shooting incident. Sisneros is facing charges of aggravated assault with a deadly weapon, being a felon in possession of a firearm, and unlawful carrying of a deadly weapon. Court records indicate that Gutierrez was apprehended by the Bernalillo County Sheriff’s Office on a warrant, but the exact location of his arrest remains undisclosed.

Police Investigation and Incident Details

According to a criminal complaint filed at Metropolitan Court, Gutierrez was identified through store surveillance footage. The Albuquerque Police Department responded to a report of a “shootout” at the Walmart location on Academy near Wyoming at around 8:15 p.m. on May 6. Witnesses reported that the altercation began when the three men involved were unable to make a cash payment at the store, which only accepted bank cards.

During the confrontation, the employee fired at the three men, resulting in one of them, later identified as Sisneros, sustaining multiple gunshot wounds. Sisneros was transported to a local hospital and was listed in stable condition. University of New Mexico Health spokesperson Brianna Wilson confirmed that Sisneros was discharged on May 15 following treatment.

Surveillance footage revealed that after the employee fell and dropped his firearm, Gutierrez picked up the weapon and fired at the fleeing employee. Gutierrez then disposed of the firearm before placing it inside a vehicle. The police discovered the firearm on the driver’s side floorboard of the vehicle. APD spokesperson Gilbert Gallegos stated in May that the vehicle linked to the shooting had been sealed pending a search warrant.

Legal Proceedings and Ongoing Investigations

Gallegos further added that Sisneros was wanted by the U.S. Marshals and had an active warrant for his arrest. The incident at the Walmart store has raised concerns about the safety and security of employees and customers alike.

The case involving Gutierrez and Sisneros is still under investigation, and further legal proceedings are expected to take place in the coming days. The Albuquerque community is urged to remain vigilant and report any suspicious activities to the authorities.
