The murder trial of former Migori Governor Okoth Obado in connection with the death of university student Sharon Otieno has come to a close after hearing testimonies from a total of 42 witnesses. The case, which dates back six years, has been closely watched by the public and has now reached a crucial stage.

Lead defence lawyer, Senior Counsel Kioko Kilukumi, has indicated that he will be submitting for a “no case to answer” in favour of Obado. Kilukumi argued that the evidence presented during the trial exonerates Obado from the murder of Sharon and her unborn baby boy, who were killed on the night of September 3, 2018.

The prosecution, led by counsel Gikui Gichuhi and Allen Mulama, will be seeking a finding that Obado, his former personal assistant Michael Oyamo, and former Migori county employee Caspal Obiero have a case to answer and should proceed to their defence. The prosecution presented evidence suggesting that Oyamo was the one who communicated with Sharon on the day of her death, leading her to a vehicle owned by Obiero’s wife that transported her to the fatal location in Homa Bay.

Lead Investigator Nicholas Ole Sena testified that Sharon was in the company of a journalist on the night of her abduction, during which the journalist escaped from the vehicle, leaving Sharon with her kidnappers who later killed her and her unborn child in a forest. Ole Sena also revealed that Obado’s wife was aware of the relationship between Obado and Sharon, as it became apparent during a trip to London.

Despite DNA evidence confirming that Obado was the father of Sharon’s unborn child, Ole Sena stated that there is no proof linking Obado to Sharon’s abduction or murder. The defence maintains that Obado was not involved in the killing of the deceased and has requested for the case to be dismissed.

Obado Allowed to Travel to China

Interestingly, Justice Cecilia Githua has granted Obado permission to travel to China between June 20, 2024, and July 4, 2024. The judge instructed the deputy registrar to provide Obado with his passport for the trip, with the document to be returned on July 9, 2024, upon his return from China.

Obado, Oyamo, and Obiero have all pleaded not guilty to the charges of murdering Sharon and her unborn child. They are currently out on bond awaiting the next steps in the legal proceedings.

Justice Githua will announce the date for the defence and prosecution to present their submissions virtually regarding the “no case to answer” argument. The trial has garnered significant public interest due to Obado’s prominent position as a former governor.
