The incident occurred at Guildford Shopping Centre on July 4, 2022, when two women reported that a man had exposed himself to them. CCTV footage from the mall showed the man, identified as Thomas Charles Cooper, adjusting his shorts and looking at his crotch multiple times.
Witnesses testified to seeing Cooper with his genitals outside of his shorts on two separate occasions, prompting them to contact security. The man, described as wearing “short shorts” and carrying a bag, claimed that his genitals accidentally slipped out when he adjusted his shorts.
During the trial, Cooper, a 53-year-old married man and owner of a bowling alley, maintained that he did not intentionally expose himself and was unaware of his actions. However, Judge Lopes found his testimony to be unreliable and concluded that he had changed his shorts to facilitate the indecent exposure.
Evidence and Testimony
The prosecution presented CCTV footage showing Cooper adjusting his shorts and looking at his crotch area multiple times while seated at the mall. Witnesses testified to seeing his genitals outside of his shorts on two occasions, with one witness stating that he made eye contact with her.
Cooper claimed that he was at the mall to buy a DVD and had changed into new shorts for exercise. He testified that he was unaware of his genitals being exposed and suggested that he may have made eye contact with the witnesses without realising it.
Judge’s Decision
Judge Lopes found Cooper guilty of indecent exposure, stating that his actions were deliberate and not accidental. She noted inconsistencies in his testimony and concluded that he had changed his shorts to facilitate the indecent act.
Cooper’s sentencing is scheduled for a later date, and he remains subject to a publication ban to protect the identity of the witnesses involved.
