Nick Groff and his wife, Tessa DelZoppo, informed the police that the altercation occurred on May 13 while Groff was out walking with their son in the driveway of their residence on Shantz Avenue. According to Groff, an unidentified man approached him and carelessly tossed a stack of paperwork into the stroller before verbally serving him with the documents. The couple stated that the paperwork struck their son in the face, causing a scratch on his cheek and prompting tears from the child. They revealed that the paperwork was related to a family court matter involving Groff’s ex-wife.
In an interview with local media, Groff expressed his outrage over the incident, describing the act as “ridiculous” and highlighting the distress it caused to his child. The individual responsible, Gary Bevilacqua, reportedly refused to identify himself initially but later provided Groff with a business card before departing from the scene.
Although Bevilacqua denied the couple’s version of events when contacted by police, Falls Police Superintendent Nicholas Ligammari confirmed that an investigation is ongoing. Bevilacqua, who works as a private process server for family court matters, was not acting in his capacity as a city marshal at the time of the alleged incident.
The responding officer who arrived at the scene noted in the police report that the child did not appear to be in significant distress and was seen smiling. A minor scratch on the boy’s cheek was observed, but no signs of severe injury were reported.
