A Shawnee police officer will not face criminal charges for the fatal shooting of a man who allegedly fired a gun inside a gas station and held a group of people hostage, Johnson County District Attorney Steve Howe announced on Monday.

During a press conference, Howe revealed that the man who was shot, identified as Brett Marshall Smiley, pointed a gun at responding officers before one of them fired at him.

Howe stated that after reviewing the incident, the Shawnee officer, whose name was not disclosed, acted appropriately and in the interest of safety for both himself and others. He deemed the use of deadly force as justified.

The shooting took place at the QuikTrip located at 20605 Shawnee Mission Parkway on February 18.

According to Howe, an autopsy revealed that Smiley had methamphetamines in his system at the time of his death. Family members also indicated that Smiley had a long history of substance abuse and mental health issues.

Howe noted that Smiley had a criminal record, and the source of the gun he used remained unclear.

Speaking at the press conference, Howe urged those dealing with mental health issues or knowing someone who is, to seek professional help. He emphasized the importance of preventing such incidents through early intervention.

According to Howe, law enforcement officers responded to the gas station following prior incidents that morning involving a man believed to be Smiley. He had visited a Hardee’s location in Olathe, where he made lewd demands and later left the store naked with a knife.

Investigators connected him to gunshots reported on K-7 highway, where spent 9 mm casings were found and matched to the gun Smiley possessed at the QuikTrip.

Shortly after 11 a.m., Smiley entered the gas station armed with a 9 mm handgun with an extended magazine. Security footage shown during the press conference captured Smiley firing a shot into the ceiling and demanding patrons to get on the ground.

Several customers were present in the store at the time of the incident, Howe stated.

Smiley later grabbed a woman in the store, expressed confusion, and repeatedly mentioned needing a “hostage” while awaiting police arrival, according to Howe’s report.

Police approached the store, and the officer who fatally shot Smiley recounted the moment, saying, “I was standing behind the car and then I yelled ‘drop the gun’ and then I stepped out and that’s whenever I saw the magazine and I saw it pointed at me and that’s when I shot him.”

Shawnee Police Chief Sam Larson commended the officers’ response that day, describing it as “textbook.”

“The actions of the Shawnee police officers the day of this incident saved lives and prevented additional injuries to customers and employees who were inside that business,” Larson stated.

The investigation into the incident was conducted by the Johnson County Officer Involved Critical Incident Investigation Team.
