A 66-year-old man from Fredericksburg, Virginia, tried to avoid a DUI charge by swapping seats with his passenger but was unsuccessful in his attempt. The incident took place on May 31 at around 5:50 p.m. in Stafford County, Virginia.

Deputy J.L. Jones noticed a blue Nissan swerving across both southbound lanes on Richmond Highway near Rappahannock Regional Jail. Almost colliding with two other vehicles, Deputy Jones received a report of a drunk driver complaint involving the same vehicle.

After pulling over the Nissan near Sage Lane, both occupants got out of the vehicle and switched seats in a bid to deceive the deputy. Despite their efforts, Deputy Jones witnessed the switch and approached the vehicle.

The original driver, who was now in the passenger seat, emitted a strong alcohol smell and provided three different false identities. Upon revealing his true identity, it was discovered that his license had been suspended due to a previous DUI offense. He admitted to consuming “two beers,” and an open can of Four Loko was found in the vehicle.

The driver was charged with driving under the influence, driving after license forfeiture, falsely identifying himself to law enforcement, a traffic lane violation, drinking while driving, and refusal to comply. He was detained at Rappahannock Regional Jail until he sobered up.
