The Berkshire District Attorney, Timothy J. Shugrue, announced the verdict following a trial in Berkshire Superior Court. In addition to the murder charge, Sumner was also convicted of possession of ammunition without a firearms identification card. The sentencing for Sumner has not yet been scheduled.

The incident took place on August 25, 2019, when Pittsfield police responded to a 911 call reporting two masked men walking around South John Street. Upon arrival, officers heard gunshots in the vicinity. They discovered a woman, later identified as 37-year-old Stephanie Olivieri, inside a running car, struggling for breath with a head wound. Despite the officers’ efforts to provide medical assistance, Olivieri was pronounced dead at Berkshire Medical Center.
