A DUI suspect accused of killing a 14-year-old girl in Newport Beach has been charged with her murder, according to the Orange County District Attorney’s Office. The suspect, Joseph Alcazar, 30, of Fontana, is facing serious charges in connection with the tragic incident that claimed the life of Rosenda Elizabeth Smiley, 14, from Rialto.

Deadly Crash in Newport Beach

The fatal crash occurred on Saturday, May 25, near Balboa Boulevard and Palm Street at approximately 6:49 p.m. The location of the incident was just a block away from the Balboa Fun Zone, a popular destination in Newport Beach. According to Newport Beach police, Smiley was crossing the street on E. Balboa Boulevard with two other individuals when the tragic event unfolded.

Reports indicate that an oncoming driver had stopped to allow the group of pedestrians to cross the road. However, Alcazar made the reckless decision to drive around the stopped car and continued through the street, ultimately striking Smiley as she was walking. The impact also resulted in a 13-year-old girl suffering injuries to her foot.

Emergency responders arrived at the scene and pronounced Smiley dead due to the severity of her injuries.

Allegations Against the Suspect

Further investigation revealed disturbing details about the incident. Alcazar had his 8-year-old daughter and another man in the car at the time of the crash. Authorities determined that the suspect was driving under the influence of alcohol, with his blood alcohol level reportedly twice the legal limit.

Additionally, it was uncovered that Alcazar had prior convictions for two DUI incidents, including one that left him seriously injured in a previous crash. These findings have led to a series of charges being filed against him.

Charges and Consequences

Alcazar has been charged with multiple offenses, including one felony count of murder, one felony count of driving under the influence of alcohol causing great bodily injury with two previous prior convictions, one felony count of driving under the influence of alcohol with a BAC of .08 or higher with two previous prior convictions, and one misdemeanor count of willful endangerment of a child.

Orange County District Attorney Todd Spitzer condemned Alcazar’s actions, stating, “A 14-year-old girl living the California dream enjoying a day of sun and sand at the beach with friends to kick off the beginning of summer is dead because of the selfish decision of a stranger.”

If convicted on all counts, Alcazar could face up to 15 years to life, in addition to six years in prison.
