Accident – Death – Obituary News : In a recent federal lawsuit filed in Cleveland, a group of current and former students from the Cleveland Heights University Heights School District have made disturbing allegations of the school’s failure to address instances of sexual misconduct properly. The lawsuit, which names the school district, board of education, superintendent, administrators, principals, and other individuals as defendants, accuses the district of violating Title IX, a federal law aimed at ensuring gender equity in education.

The lawsuit details five separate incidents that occurred at Fairfax Elementary School, Roxboro Middle School, and Cleveland Heights High School. One particularly troubling incident involved a kindergartener who was allegedly subjected to inappropriate touching by another kindergartener back in 2012. Despite the parents’ notification to the school, the requested actions to address the situation were reportedly not taken, leading to ongoing trauma for the child.

Another incident at Roxboro Middle School in 2015-2016 involved a 14-year-old allegedly sexually assaulting an 11-year-old behind the school’s auditorium. Shockingly, the victim was suspended for engaging in sexual conduct on campus, with no further action taken by the school. These incidents highlight the serious failures in addressing and preventing sexual misconduct within the school district.

The plaintiffs’ attorney, Eric Long, emphasized the importance of holding schools accountable for their obligations under Title IX. He noted that while the district has made some changes, including appointing a full-time Title IX Coordinator and implementing a consent-based curriculum, more needs to be done to ensure the safety and well-being of students.

The lawsuit also highlights a case where a freshman at Cleveland Heights High School accused a sophomore of rape, which allegedly took place outside of school premises. Despite the formal complaint filed with the district’s Title IX coordinator, the investigation took nine months to complete, during which the accused continued attending school without restrictions.

Long believes that the families involved in the lawsuit are just the beginning and that there may be more victims who have not come forward. He commended the courage of the families for speaking out and seeking justice for the harm they endured. The lawsuit serves as a wake-up call to the school district to take immediate and effective action to prevent future incidents of sexual misconduct and ensure a safe learning environment for all students..
