A 33-year-old woman from Fairfield, Elena Lindsey McGraw-Ogans, is set to appear for a preliminary hearing in Solano County Superior Court. She has been charged with vehicular manslaughter with gross negligence following the tragic death of a Fairfield student in a school crosswalk back in March 2023.

At her arraignment in Department 21 on May 17, Commissioner Susan Rados scheduled the preliminary hearing for McGraw-Ogans to take place at 8:30 a.m. on Tuesday in Department 8 at the Justice Center.

McGraw-Ogans, who is currently out on a pretrial services contract, will face Judge Wendy Getty for the hearing and the appointment of an attorney.

Legal Proceedings

During the arraignment, McGraw-Ogans was represented by Deputy Public Defender James A. Mulgannon, while Deputy District Attorney Courtney Anderson appeared on behalf of the DA’s Office. McGraw-Ogans entered a not-guilty plea to all charges, waived formal arraignment, and denied any prior offenses, enhancements, and allegations.

She agreed to a pretrial services contract, which includes abstaining from illegal drugs and alcohol, complying with drug and alcohol testing, and participating in counseling as ordered by the court.

Tragic Incident

The charges against McGraw-Ogans stem from an incident over a year ago, where an 11-year-old girl lost her life in Fairfield while using a school crosswalk on March 23, 2023. The criminal complaint was filed on April 26.

Following an investigation by Fairfield police, an arrest warrant was issued for McGraw-Ogans. She was arrested on May 16 and booked into Solano County Jail on suspicion of vehicular manslaughter with gross negligence.

Police reported that the collision occurred outside Grange Middle School, where the child was struck by a vehicle while using the crosswalk. McGraw-Ogans, the driver of the vehicle, was believed to be under the influence of alcohol and drugs at the time of the accident.

Legal Consequences

If found guilty at trial, McGraw-Ogans could face up to six years in state prison and a fine of up to £10,000 for the felony charge. The seriousness of the allegations underscores the importance of adhering to road safety regulations and avoiding impaired driving.
