A decision on whether the teenager responsible for the tragic accident that claimed the lives of two individuals in Pune should be tried as an adult will be made by the Juvenile Justice Board, as per the lawyer representing the accused.
During a press conference in Pune on May 22, Prashant Patil, the lawyer for the accused, explained, “The Juvenile Justice Act outlines procedures to determine whether the accused Child in Conflict with Law (CCL) should be considered a minor or an adult. This process typically takes around 90 days to complete.”
Procedures for Determining Juvenile’s Status
Patil further elaborated on the steps involved in determining the status of a juvenile or CCL arrested in a case. He noted that investigative agencies must file a charge sheet within 30 days of the arrest to consider the individual as an adult. Following the filing of the charge sheet, a two-month procedure commences, including psychological and social assessments along with a de-addiction test.
According to the lawyer, the individual under assessment does not need to remain in rehabilitation during these procedures, as the investigation continues. The Juvenile Justice Board closely monitors the assessments through regular reports and complaints, ultimately deciding after the 90-day period whether to treat the minor or CCL as an adult.
Juvenile Justice Board’s Decision
On the evening of May 22, the Juvenile Justice Board cancelled the bail of the 17-year-old accused involved in the Porsche car accident that resulted in the tragic deaths. The accused has been remanded to a home for rehabilitation for a period of 14 days, until June 5.
Pune Commissioner of Police, Amitesh Kumar, confirmed that a review application had been filed before the Juvenile Justice Board to request the juvenile be treated as an adult in the case and placed in a remand home.
Tragic Incident Details
The accident, which occurred in the early hours of May 19, claimed the lives of two IT professionals, Ashwini Koshta and Aneesh Awadhia, both from Madhya Pradesh. The accused, driving a luxury car, collided with the victims on a motorcycle.
Further investigations revealed that the accused’s father had not been cooperative in the inquiry, leading the Pune police to seek him for additional questioning. The father misled the police by falsely claiming he was in Shirdi when he was actually in Aurangabad.
Bar Involvement and Consequences
Authorities also sought the custody of the bar staff that served alcohol to the accused teenager and his friend before the tragic accident. The lack of signage indicating alcohol could not be served to minors at the bar led to its closure by the Pune Excise Department on May 21. The bar managers were subsequently arrested by the police.
