A Federal Judge Dismisses Lawsuit Against U.S. Attorney General Merrick Garland
In a recent legal development, a federal judge has thrown out a lawsuit against U.S. Attorney General Merrick Garland, citing similarities with a previous case involving MyPillow CEO Mike Lindell.
The lawsuit was filed by Tina Peters, a Republican and former clerk in Mesa County, who is facing charges of state official misconduct. Peters attempted to sue the federal government and Garland to halt a federal investigation into potential identity theft, intentional damage to a protected computer, and conspiracy. Both Peters and Lindell were identified as subjects of this investigation in 2022.
Alongside Garland, Peters also sued Colorado Secretary of State Jena Griswold and Mesa County District Attorney Daniel Rubinstein, alleging that she was being targeted for questioning the legitimacy of President Joe Biden’s election and raising concerns about election security.
Peters, known for her involvement in the 2020 election conspiracy movie “[S]election Code,” is accused of tampering with election equipment, attempting to influence public servants, and engaging in official misconduct by allowing unauthorized access to voting machine hard drives. This led to confidential digital images of county Dominion Voting Systems equipment and passwords being leaked online.
Despite Peters claiming innocence and asserting that her actions were not intended to compromise the election system, the lawsuit failed to gain traction in court.
Judge’s Ruling and Comparison to Mike Lindell’s Case
U.S. District Judge Nina Wang, appointed by President Biden, dismissed Peters’ lawsuit, drawing parallels to Mike Lindell’s unsuccessful litigation efforts. Wang highlighted that Peters’ equitable jurisdiction arguments were not persuasive, echoing the outcome of Lindell’s case.
Quoting the U.S. Court of Appeals for the Eighth Circuit’s decision in Lindell’s case, Wang emphasized that granting relief in such lawsuits could set a precedent for similar legal challenges from individuals under federal investigation.
Additionally, Wang referenced a dismissed lawsuit by pardoned former Trump campaign chairman Paul Manafort against the DOJ, reinforcing the court’s stance against using civil actions to interfere with criminal investigations.
First Amendment Arguments and Dismissal of the Lawsuit
The judge rejected Peters’ First Amendment arguments, stating that the government’s actions were not aimed at suppressing free speech but rather enforcing federal law. Wang emphasized that Peters did not provide evidence of government harassment or bad faith in their investigation.
Ultimately, Wang sided with the DOJ and dismissed Peters’ lawsuit without prejudice, leaving open the possibility for future legal action. Similarly, Lindell dropped his lawsuit following the Supreme Court’s rejection of his case.
