DELHI, NY (WBNG) — The Delaware County District Attorney’s Office revealed on Thursday that Cruz Garcia, a 44-year-old man, has been formally indicted by a grand jury on multiple charges.
Among the charges brought against Garcia are serious felony charges, including unlawful imprisonment in the first degree and attempted assault in the second degree. Additionally, he faces a misdemeanor charge of criminal obstruction of breathing.
The indictment accuses Garcia, described by the DA’s office as an undocumented immigrant, of attempting to inflict severe physical harm on a female victim by strangling her. It also alleges that he unlawfully detained the victim against her will. The incident took place on or around June 25, 2023, in the Town of Middleton, NY.
Following the indictment, Garcia was arraigned in Delaware County Court on May 21. Due to unrelated charges, he was remanded to the county correctional facility. In a separate incident in August 2023, Garcia, who had been released on bail, was indicted on a rape charge.
In response to the recent indictment, Delaware County District Attorney Shawn Smith expressed his appreciation for the investigative efforts of New York State Police Investigator Adam Cernauskas and Trooper Siobhan Carey. He also thanked the staff at Safe Against Violence for their unwavering support of the victim.
A spokesperson for the DA’s office confirmed that the Office of Immigration & Customs Enforcement (ICE) has agreed to halt deportation proceedings until the conclusion of the prosecution against Garcia.
