A 27-year-old man from Fairfield, accused of killing two men and injuring a third in a shooting incident that took place in March 2022, is set to face a jury trial in Solano County Superior Court in October.

Trine Daniel Martinez, who pleaded not guilty to the charges, appeared in Department 11 on May 6. Judge William J. Pendergast III scheduled the trial to commence at 9:30 a.m. on October 28 at the Justice Center in Fairfield. Prior to the trial, a trial management conference has been set for 8:30 a.m. on October 24.

Martinez, who turned himself in to the Fairfield Police Department and was arrested on March 14, has denied all allegations and enhancements. He is currently being held without bail at the Stanton Correctional Facility in Fairfield and is represented by criminal defense attorney Thomas Maas. The prosecution is led by Deputy District Attorney Bill Ainsworth from the Solano County DA’s Office.

The victims of the shooting have been identified as Earl Wayne Wyatt III, 44, from Fairfield, who died at the scene, and Damion Davis, 36, from Suisun City, who was critically wounded and later succumbed to his injuries at a local hospital.

Martinez was identified as the suspect in the shooting through surveillance footage from a convenience store on East Tabor Avenue. Following his surrender, he was accompanied by criminal defense attorney Daniel J. Russo. Martinez faces two counts of first-degree murder and one count of attempted murder.

The incident was triggered by an altercation between the individuals involved, as confirmed by investigators. Officers responding to reports of gunshots found the three victims near a business premises, with Wyatt pronounced dead at the scene. Davis and the third victim were transported to a hospital for treatment.

After obtaining an arrest warrant for murder, Martinez was taken into custody and a search warrant was executed at his residence on San Jose Street in Fairfield. The criminal complaint was filed on March 16, 2022.

If convicted at trial, Martinez could face a sentence of over 50 years to life in prison, with additional penalties for firearm usage.
