American Airlines has recently come under fire for a disturbing incident involving a 9-year-old girl who was allegedly filmed in an airplane bathroom by a flight attendant. In response to a civil lawsuit filed by the family of the young girl, attorneys for the airline made a shocking claim – they suggested that the victim was at fault for the incident.

According to the amended lawsuit filed in Travis County, Texas, on April 20, the attorneys for American Airlines argued that the girl should have been aware that she was being recorded while using the bathroom during a flight from Austin, Texas, to Los Angeles, Calif., in January 2023. The filing stated that any injuries sustained by the girl were a result of her own negligence and that she should have known that there was a visible and illuminated recording device in the lavatory.

The accused flight attendant, identified as Estes Carter Thompson III, was also defended in the filing. The attorneys claimed that Thompson was not acting within the course and scope of his employment at the time of the alleged incident.

In response to the filing, the attorney representing the 9-year-old girl expressed outrage at the airline’s defense. Paul Llewellyn of Lewis & Llewellyn LLP condemned the company’s attempt to blame a child for being filmed in such a manner.

The girl’s mother also voiced her shock and anger at the airline’s response, calling it a “depraved legal strategy” that sinks to a new low. She criticized American Airlines for shifting the blame to her daughter instead of taking responsibility for the incident.

Following the backlash, American Airlines released a statement distancing the company from the filing. The airline acknowledged that their attorneys had made an error and stated that the defense would be changed. The company emphasized that they do not believe the child is at fault and take the allegations involving their former employee seriously.

The incident involving Thompson is not an isolated one. He was previously arrested in January in Lynchburg, Va., for allegedly filming a 14-year-old girl in an airplane bathroom on a flight from Charlotte, N.C., to Boston, Mass. Prosecutors allege that Thompson had other surreptitiously recorded videos of minor females using the bathroom on aircrafts he previously worked on.

Thompson, 36, was indicted on charges of attempted sexual exploitation of children and possession of child pornography in connection with the incident involving the 14-year-old girl. He pleaded not guilty to the charges in federal court and is expected to appear in court again on July 1.

The disturbing nature of these incidents has brought attention to the issue of passenger safety and the responsibility of airlines to ensure the well-being of their customers. American Airlines has faced criticism for their handling of the situation and will need to address the concerns raised by the public and the victims involved.
