The family of Hector Francisco Vancini, aged 54, has taken legal action against a Longview restaurant following his untimely death earlier this year. The incident occurred on January 17 in the parking lot of On the Border, located within the Longview Mall.

A representative from the Houston-based law firm of Paranjpe Mahadass Ruemke, Tej Paranjpe, expressed that while no amount of compensation can replace the loss suffered by Vancini’s family, they aim to establish a precedent for restaurants nationwide. Paranjpe stated, “This was a tragic event that could have been prevented if the responsible parties had fulfilled their obligations to their patrons.”

According to the lawsuit, Vancini was enjoying a meal with a friend at On the Border when a group of other customers initiated a confrontation, making threats towards the two men. Despite the altercation escalating in the dining area, the lawsuit alleges that the restaurant continued to serve alcohol to the individuals involved.

As Vancini and his friend exited the establishment, the same group followed them into the parking lot, where the situation escalated to physical violence, with the group shoving and hitting the two men.

Video footage captured the moment when Vancini and his friend were accosted by a man identified as 35-year-old Treboria Wallace, who allegedly struck Vancini in the head, causing him to fall and sustain fatal injuries upon hitting the pavement. Vancini succumbed to his injuries after being rushed to a hospital.

Although Wallace was arrested on a charge of aggravated assault causing bodily harm, he has not yet faced charges related to Vancini’s death.

Paranjpe reiterated that the incident was a clear case of negligence, highlighting the intoxicated state of the individuals involved and asserting that both restaurant management and mall security should have intervened to prevent the tragic outcome. He emphasised, “As a result of their inaction, a father was taken away from his family prematurely.”
