A man from Libby, Montana, has been sentenced to serve time in the Montana State Prison after pleading guilty to felony sexual assault against a victim under the age of 16. Robert William Emerick, 34, who hails from Anaconda, entered his plea on February 26 in Lincoln County District Court.
Presiding over the case, District Judge Matt Cuffe upheld the terms of the plea agreement negotiated between Emerick’s public defender, Ben Kolter, and County Attorney Marcia Boris. As part of the sentencing, Emerick will serve a total of 10 years, with six of those years being suspended. Despite facing a maximum sentence of 100 years, Emerick is currently being held at the Lincoln County Detention Center on $100,000 bail.
In addition to the prison sentence, Emerick has been mandated to complete two phases of sex offender treatment before being eligible for release. He has been classified as a Tier 1 sex offender, indicating a low risk of reoffending.
During the court proceedings, Emerick chose not to make a statement regarding the charges brought against him. The criminal acts in question occurred during the summer of 2023.

The report detailed an alleged sexual assault involving a 14-year-old girl, with the perpetrator accused of engaging in inappropriate behaviour between July 1, 2023, and July 31, 2023.
Following the report, County Detective Duane Rhodes conducted interviews with the victim. The girl disclosed to her father that Emerick had entered her room in the early hours of the morning while she was asleep. Allegedly, he climbed into her bed, touched her breasts over her bra, and proceeded to engage in oral sex after moving aside her underwear.
